Risks & source coverage

  • LEGAL Reported December 4, 2023; lawsuit filed the prior week In November 2023, the development entity for Swerdlow’s Block 55/Sawyer’s Walk project sued Arquitectonica, alleging design-coordination and review failures by the architect and its subcontractors that produced 170 change orders totaling about $16 million; Arquitectonica did not respond to the publication’s requests for comment, and the retrieved report does not state the case’s outcome.
  • LEGAL Filed March 2020; final judgment reported October 2021 A Peebles affiliate sued Swerdlow, its Downtown Retail Associates affiliate and partner Alben Duffie, alleging that CRA officials and the developers maneuvered it out of the Overtown development opportunity; the court struck major claims, the remaining claims were dropped, and a final judgment ended the litigation, while Swerdlow’s attorney said the allegations had no merit.
  • FINANCIAL DISTRESS Foreclosure and receivership reported April 20, 2011; loan delinquency reported February 24, 2011 Biscayne Landing, originally envisioned by Swerdlow Group and later sold to a Boca Developers affiliate, became subject to loan default, foreclosure and court-appointed receivership after the affiliate built only a small fraction of the planned residential units; the reported delinquency was attributed to the project’s special servicer/Boca-related ownership, not stated as a default by Swerdlow Group itself.

Click a row in the chart to open a project, or a table row below to see its sources. The chart runs wider than the page where the record spans many years — scroll it sideways to follow a project to its handover. Every date we have is drawn. A hollow marker is only a launch year, not a date anyone published. No dates published means we looked and found none; dates not yet checked means we have not looked yet. Handing over is not finished — rows say which. A delay is shown when one source gives the promised date and another gives the real one, however rough: "2019" still counts, and the row shows how wide that is. Projects missing one of the two dates, or with sources that disagree, are left out of the figures. 1 turned out to be about something else — a phase, a neighbour, the wider masterplan — and is marked off-subject.

Student.com publishes a 3.9/5 building rating based on 50 Google reviews, while the place listing reports 3.9/5 from 47 reviews; the larger published review base sets the 6.7 anchor conversion. The reported complaints outweigh the praise modestly, especially the management and security/access concerns, producing a 6.0 overall resident score. Structural scoring is limited to the isolated dangerous-parking-layout report, so it is substantially less certain than the living score.

+ Beautifully done building+ Outstanding amenities
− Dangerous parking-garage layout
+ Beautiful pool+ Barbecue area+ Hot jacuzzi+ Helpful staff+ Walkable shopping and entertainment
− Poor management communication− Sudden policy changes− Application/document confusion− Parking-management complaints− Security/access concerns

The published reviews contain little direct evidence on framework, plumbing, HVAC or electrical systems. One reviewer nevertheless described the parking garage as having a “very poorly made and dangerous layout,” specifically at the entry and exit ramp; this is an isolated physical-environment complaint, not evidence of a wider structural defect.

Residents praise the “beautiful” pool, barbecue area and hot jacuzzi, and one reviewer said staff were “extremely helpful” and the move-in was smooth. The negative reviews describe management as poorly communicative and dismissive, while another reports that pool access was locked after 6 p.m. and alleged people entering through a back door.

Only buildings that have reached handover are rated. 0 of 1 project carry no rating: a building still under construction is never asked about, one that has just been handed over may not have been reached yet, and the rest were asked about and no published resident commentary was found. Structure is fixed at handover and stays the developer's; management and living belongs to whoever runs the building now. The overall verdict weights both rather than averaging them. None of this is checked: a rating is what people published about a building, aggregated — it is not evidence, it cannot move a delay figure, and it is not part of the delivery record above.

Projects

Assessment coverage

Completed projects: 2016-10-15 through 2026-10-15. Initial research is capped at 10 completed projects and a separate delivery-risk search capped at 7 findings. Risk findings are not project assessment counts. Absence is not proof of a complete portfolio or no failures. Month-level dates overlapping a boundary are excluded from figures.

0 undated completions and 0 boundary-uncertain completions are retained but excluded from figures.

Stalled, cancelled & overdue projects

0 evidenced cases
The capped delivery-risk search ran; no project-level exception cases are recorded here. Risk findings are listed under Risks and are separate from assessed projects. This does not establish that the developer has no delivery failures.

Risks

Risk flags

4 found
LEGAL Reported December 4, 2023; lawsuit filed the prior week
In November 2023, the development entity for Swerdlow’s Block 55/Sawyer’s Walk project sued Arquitectonica, alleging design-coordination and review failures by the architect and its subcontractors that produced 170 change orders totaling about $16 million; Arquitectonica did not respond to the publication’s requests for comment, and the retrieved report does not state the case’s outcome.
LEGAL Filed March 2020; final judgment reported October 2021
A Peebles affiliate sued Swerdlow, its Downtown Retail Associates affiliate and partner Alben Duffie, alleging that CRA officials and the developers maneuvered it out of the Overtown development opportunity; the court struck major claims, the remaining claims were dropped, and a final judgment ended the litigation, while Swerdlow’s attorney said the allegations had no merit.
FINANCIAL DISTRESS Foreclosure and receivership reported April 20, 2011; loan delinquency reported February 24, 2011
Biscayne Landing, originally envisioned by Swerdlow Group and later sold to a Boca Developers affiliate, became subject to loan default, foreclosure and court-appointed receivership after the affiliate built only a small fraction of the planned residential units; the reported delinquency was attributed to the project’s special servicer/Boca-related ownership, not stated as a default by Swerdlow Group itself.
DELIVERY DELAY 2011-02-24 reporting on default and limited construction; 2022-12-20 reporting on the project’s continued incomplete/languishing history; 2024-11-06 appellate foreclosure decision
Biscayne Landing remained a materially incomplete and troubled redevelopment: reporting says the former partners let the project languish during the housing crash, only a small fraction of the planned development was built, and later foreclosure-related litigation involving Michael Swerdlow continued; Swerdlow’s group says it sold its partnership interests to LeFrak in 2016, so this legacy failure is not presented as a current Swerdlow-controlled project.
